Patent Proofreading
MaxVal has been working since 2005 with our Fortune 1000 customers to develop best practices in patent proofreading. Given the number of patents that we have proofread, we have designed pragmatic best practices that mitigate risk, save time and costs.
Key Features of the Service
Since the USPTO does not provide applicants with a
copy of the patent text before final printing, errors that
appear in the published patent are generally flagged using
a Certificate of Correction that is appended to the published patent. MaxVal has developed and follows seven best practices which include:
- Ensure that examiner’s amendments are captured
- Identify errors introduced by examiner’s amendments
- Catch applicant’s errors, particularly those that are (unintentionally) introduced while complying with office actions
- Identify and fix antecedent basis errors
- Include "suggestions" for errors if applicable, and if not a clear error, flag with explanation of potential error
- Follow guidelines for the issuance of a Certificate of Correction (CoC)
- Provide a review for continuity and bibliographic information for errors or inconsistencies
Benefits
Combining our proprietary proofreading tools with well-proven practices such as identifying different errors and using common patent language and U.S. conventions result in our clients reaping several benefits:
- Output satisfies the exacting expectations of patent counsel
- Certificate of Correction generated when appropriate
- Efforts produce substantial savings avoiding costly last minute corrections
- Clear value-adds which identify discrepancies and mitigate risk introduced from ambiguity and/or inaccuracies that affect enforceability
- Seamlessly integrated into client’s work flow
